THIS IS A LEGAL AGREEMENT. BY USING THE SITE, YOU ARE ACCEPTING AND AGREEING TO THESE TERMS & CONDITIONS ON BEHALF OF YOURSELF OR THE ENTITY YOU REPRESENT. YOU REPRESENT THAT YOU ARE OF SUFFICIENT LEGAL AGE IN YOUR JURISDICTION OR RESIDENCE TO ENTER INTO THIS AGREEMENT. IF YOU DO NOT AGREE WITH ANY OF THE PROVISIONS OF THESE TERMS & CONDITIONS, YOU SHOULD DISCONNECT THIS SERVICE AND CEASE USING IT.

For purposes of this Agreement:

• "Content" means reports, information, graphics, images, audio, video or other materials.
• "Representative" means an entity and its Affiliate(s), any director, officer, employee, consultant, contractor, agent, distributor, or attorney associated with the service.
• "Applicable Laws" shall mean and include all applicable statutes, enactments, acts of Congress or legislature, ordinances, rules, by-laws, regulations, notifications, guidelines, policies, directions, directives and orders of any governmental authority, tribunal, or courts of England and Wales.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and Bume International Ltd , registered in England and Wales with Company number 15999143 , and registered office of 124 City Road, London, EC1V 2NX, trading as Sure Credit ("we", "us", "our"), governing your use of our website located at www.surecredit.io and any associated services or domains (collectively, the "Website" or "Services"). By accessing or using the Website or any of the Services, you expressly acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. We may, at our sole discretion, modify or revise these Terms of Service, our policies, and the pricing of our Services at any time by posting notice on our Website and/or through the Services. You agree to be bound by such modifications or revisions. For clarity, any free service we offer may be converted into a paid subscription service at any time. Although we may attempt to notify you when major changes are made to these Terms, you should periodically review them. All changes will be effective immediately upon posting and will apply to all subsequent access to and use of the Website. Nothing in these Terms shall be deemed to confer any third-party rights or benefits.

1. Scope of Services

   1.1 Financial Account Summary

   Sure Credit provides a digital financial wellbeing platform that allows users to consolidate and track their credit information. We aggregate credit scores and related data from the three major credit bureaus: Experian, Equifax, and TransUnion. Users who register on our platform will be granted access to a personalised dashboard containing a suite of digital tools, including credit monitoring, credit score tracking, financial alerts, educational content, and other relevant insights.

   We do not modify or influence the data provided by third parties, nor do we guarantee the accuracy, timeliness, or completeness of such information. The Services are provided for informational and educational purposes only. We are not a credit bureau, credit repair organisation, financial advisor, or legal service provider.

   You agree that we and our providers have no liability for any information - accurate or inaccurate, complete or incomplete - in the materials or any reports provided to you as part of the products.

   1.2 Loan Referral Service

   1.2.1 We are not a lender, broker, or credit intermediary. We do not make loans or credit decisions. We do not guarantee loan approval, specific terms, or rates. We do not endorse or recommend any particular third-party product or service. The loan products displayed are advertisements from third-party lenders, and we may receive compensation from such third parties, which may influence the loan offers shown. This service may not be available in certain states. These products and services are covered by our Advertising Disclosure.

   Our service enables you to submit a loan request form ("Request"). Once you submit a Request we will share your information with our third-party lenders. By submitting a Request, you understand and agree that you are requesting loan offers from these third parties. You also agree that Sure Credit and our third-party lenders may contact you by any means (including email, telephone, SMS, and direct mail) to assist in processing your Request.

   Using our Website or Services does not affect your credit score. Loan eligibility is determined solely by the lender based on their independent criteria. We do not compare loan offers or collect detailed financial data for the purpose of matching or pre-qualifying users.

   All third-party products and services are governed by their own respective terms, conditions, and privacy policies. We do not endorse or assume responsibility for the accuracy or legitimacy of any content or offer provided by third-party advertisers.

   Some lenders may be tribal lenders operating under tribal law, which may not align with state laws regarding interest rates and feed. Tribal loans may have higher costs and different dispute resolution methods, such as tribal arbitration. We strongly encourage you to review loan terms before proceeding.

   1.2.2 Credit Authorization

   Lenders who receive your Request will review your information in real-time to determine whether it meets their underwriting criteria. To assess your eligibility for loan offers, Lenders may use your Request information to perform credit checks. By submitting a Request, you provide explicit consent for these checks, as detailed below:

   Lenders may conduct two types of credit checks:

   • Soft Credit Check: A credit inquiry that does not impact your credit score. This type of check is typically used to pre-qualify your loan request.
   • Hard Credit Check: A formal credit inquiry that may impact your credit score. This check is performed only when necessary for finalizing loan approval.

   Lenders may access your credit information from major credit bureaus, such as TransUnion, Experian, and Equifax. They may also use alternative data providers, including Microbilt, DataX, and Teletrack.

   By submitting your Request Form, you authorize Lenders to access and review your credit information from the sources mentioned above. These checks are conducted in compliance with the Fair Credit Reporting Act (FCRA) and other applicable laws.

   If a Lender determines that your information meets their underwriting criteria, your browser will be redirected to their website for further processing. Once redirected, the Lenders terms, privacy policies, and procedures will govern your interactions and any subsequent loan agreement.

   Lenders may retain your information, regardless of whether you are approved for a loan. Your data may also be used to provide additional financial product offers or related services, as authorized under our Privacy Policy.

2. Third Party Product Services

   In connection with your use of the Services and as part of the functionality of the Services as may be applicable, you may have access to certain online services or information that may be made available by your bank and/or other third party provider(s) ("Provider Services"), including online banking, online payment, online investment account download, online bill pay, online trading, and other account information available from third party provider(s).

   The Services may be designed to allow access to Provider Services (if and to the extent provided by users' provider(s)) to set up banking and other information, schedule the Services to access user account(s), download transactions into the Services and otherwise aggregate information from user account(s) with third party provider(s). Sure Credit has no control over the provision of Provider Services or provision of access to the Provider Services by users' provider(s). We do not guarantee the Provider Services.

   You agree that you may be able to use the Services in conjunction with the Provider Services, and that Sure Credit disclaims any and all liability whatsoever for any actions or inactions on the part of your provider(s) resulting in any inability to use the Services to access accounts, obtain data, download transactions, or otherwise use or access the Provider Services.

   You acknowledge and agree when you access data and information through the Services, third party provider account access number(s), password(s), security question(s) and answer(s), account number(s), login information, and any other security or access information, and the actual data in your user account(s) with such provider(s) such as bank and other account balances, credit card charges, debits and deposits as may be applicable (collectively, "Provider Account Data"), may be collected and stored in the Services. In accessing and using the Services you represent that you are the legal owner of the Provider Account Data and that you have the authority to appoint, and do expressly appoint, Sure Credit or our third party providers as your agent with limited power of attorney to access and retrieve Provider Account Data on your behalf.

   You further acknowledge and agree that (i) some providers may not allow the Services to access the Provider Services, (ii) providers may make changes to their websites, with or without notice to Sure Credit, that may prevent or delay aggregation of information from such websites, and (iii) the Services may "refresh" the Provider Account Data by collecting the Provider Account Data nightly, so your most recent transactions may not be reflected in any account balances or other account information presented to users in the Services. In the event that you see a discrepancy in the Provider Account Data, and in any case before making any transactions or decisions based on such account information presented in the Services, you agree to check the last refresh date for the account and confirm with that applicable provider that the Provider Account Data is correct or otherwise confirm that Provider Account Data is up to date and accurate.

3. Account Registration and Responsibilities

   To use certain Services, you must register and create an account. You agree to provide accurate, current, and complete information during the registration process and to maintain and promptly update such information as necessary.

   You are solely responsible for safeguarding your account credentials, including your password and any other security information. You agree to notify us immediately if you become aware of any unauthorised use of your account or any breach of security.

   You accept full responsibility for any activity that occurs under your account. We shall not be liable for any loss or damage arising from your failure to comply with these obligations.

4. Subscription Plans and Payment Terms

   Some features of the Services may be offered under paid subscription plans. Subscription details, including trial periods, billing amounts, billing cycles, and payment methods, are disclosed on our Website at the time of enrolment.

   Your subscription will commence upon confirmation of payment and may begin with a trial or verification period, the terms of which are stated at checkout. At the end of the applicable trial period, unless cancelled by you, the subscription will automatically convert to a paid plan and your payment method will be charged accordingly.

   You authorise us to charge your payment method on a recurring basis for the applicable fees related to your subscription. You are responsible for keeping your billing and contact information current.

   All fees are exclusive of taxes, levis, or duties imposed by taxing authorities; you arte responsible for paying any such applicable tax.

   You acknowledge that the amount due may vary for reasons that include, promotional offer expiry, changes in your account, or changes in the amount of applicable sales tax, and you authorize us to bill you for such varying amounts.

   Subscription fees are non-refundable except where required by law. We reserve the right to change our fees or introduce new charges with reasonable prior notice.

   By registering for a subscription, you warrant that:

   1. you are of the age of majority in the jurisdiction in which you reside,
   2. all information you submit is true and correct, and
   3. you are the owner of the credit card or bank account you designated for your subscription Account.
5. Cancellations and Termination

   You may cancel your subscription at any time by contacting our support team or visiting us.surecredit.io/cancel-request. Upon cancellation, you will no longer be billed for future periods, but we do not provide refunds or partial credits for unused time in the billing month.

   We reserve the right to suspend or terminate your account and access to the Services at our sole discretion if we believe you have violated these Terms, engaged in fraudulent activity, or posed a legal risk to us or our partners. We may also terminate or suspend services at any time due to business or operational reasons.

6. Electronic Consent

   By using our services and submitting your information through our platform, you agree to conduct transactions electronically with Sure Credit and our participating Lender Partners. This consent applies to all aspects of the loan process and related services. Please read this section carefully as it outlines your rights and obligations under the E-SIGN Act.

   You consent to receive all disclosures, agreements, communications, notices, and other documents electronically, including: Loan agreements, Privacy notices, Payment reminders and debt collection communications.

   Your electronic signature carries the same legal weight as a physical signature.

   To access and retain electronic disclosures, you must have: a device with an internet connection, a current web browser capable of supporting secure connections, a PDF reader, and an email account.

   By providing your consent, you confirm that you have the necessary hardware and software to receive and retain such communications.

   You may withdraw your E-Consent at any time by contacting the respective party.

   Note: Withdrawal may result in delays or prevent you from completing the loan process, and contact information for withdrawing consent will be provided by the party.

   You have the right to request paper copies of any electronic records. Contact the respective Lender Partner for assistance. Fees may apply for paper requests.

   This E-Consent applies to all communications during the delivery of the Services, the loan request process and, where applicable, throughout the term of your loan or related services.

7. Data Collection and Use

   These terms are subject to our Privacy Policy. In compliance with the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), as well as similar state privacy laws, you have the following rights:

   • Right to Know: You may request details about the personal information we collect, including the categories of information, the sources, and how we use or disclose it.
   • Right to Delete: You may request that we delete the personal information we have collected about you, subject to certain exceptions permitted by law.
   • Right to Opt-Out of Sale or Sharing: You may direct us not to sell or share your personal information with third parties. While we do not sell personal information in the traditional sense, some data uses may qualify as a "sale" or "sharing" under state laws.
   • Right to Non-Discrimination: You will not be denied services, charged different prices, or offered different levels of service based on exercising your privacy rights.

   You must inform Sure Credit of, and hereby grant to Sure Credit and its affiliates, third-party providers, partners, licensors, employees, distributors and agents permission to use the Account Information to enable us to provide the Services to you, including updating and maintaining Account Data, addressing errors or service interruptions, and to enhance the types of data and services we may provide to you in the future.

   When you have made a loan request and we are unable to connect you with a lender directly or through our referral network, we may refer you to other financial products or services such as debt relief, or other related solutions. These services are provided by third-party partners or referral networks, and your information may be shared with these providers to facilitate your connection. By submitting your information, you consent to being referred to these alternative services.

   We may use, modify, display, distribute and create new materials using the Account Information, Account Data and/or your Communications to provide the Services to you. By submitting Account Information, Account Data and Communications, you agree that we may use your Account Information, Account Data and Communications for the purposes set out herein, without any particular time limit.

   Anonymous, aggregate information that does not contain personally identifiable information, comprising financial account balances, other financial account data, or other available data that is collected through users' use of the Services, may be used or licensed by us for various purposes including but not limited to conducting certain analytical research, performance tracking, benchmarking helping to improve products and services and to assist in troubleshooting and technical support.

   To the extent that a user requests customer service or other assistance from us, you agree that we are authorized to access and view your account information to provide such assistance and support.

8. Electronic Communications

   By registering for a subscription or membership, you consent to receive communications from us electronically and agree to be added to our customer email list, as well as our SMS text message customer list. We may communicate with you by email, text message, by posting notices on the Website, by delivering notifications through our mobile applications or through other electronic means. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. We may send you email newsletters on a variety of topics, and may send you emails on behalf of pre-screened third parties containing promotional offers or opportunities that we believe may be of interest to you. Additionally, even if you opt-out of marketing emails or sms, if you are registered or have requested that we contact you about our products or services, you authorize us to send you important notices about the products or services and any pending transactions to any email address or mobile number you provide to us.

9. Offers from Third Parties

   While you are on the Site, or otherwise in connection with, or arising out of, your purchase of or viewing of our Products, you may receive offers from third parties that are unrelated to Sure Credit. You do not have to accept those offers to enrol in any of the Products or to use or accept the Products. However, if you do accept any third-party offers, or visit any websites regarding such offers, you do so subject to the Terms and Conditions (sometimes also referred to as Terms of Use or Terms of Site) and the Privacy Policies of those offers and sites. You acknowledge that Sure Credit has no control over, or liability for, any offer, statement or any other matter connected to or associated with such offers.

10. Consumer Credit File Rights

    You have a right to dispute inaccurate information in your credit report by contacting the credit bureau directly. However, neither you nor any "credit repair" company or consultant has the right to have accurate, current, and verifiable information removed from your credit report.

    The credit bureau must remove accurate, negative information from your report only if it is over seven years old. Bankruptcy information can be reported for ten years.

    You have a right to obtain a copy of your credit report from a credit bureau. You may be charged a reasonable fee. There is no fee, however, if you have been turned down for credit, employment, insurance, or a rental dwelling because of information in your credit report within the preceding 60 days.

    The credit bureau must provide someone to help you interpret the information in your credit file.

    You are entitled to receive a free copy of your credit report if you are unemployed and intend to apply for employment within 60 days, if you are receiving public welfare assistance, or if you have reason to believe that there is inaccurate information in your credit report due to fraud.

    A full disclosure of information in your file at the three national credit repositories must be obtained directly from the repositories by contacting: Experian: 1-888-397-3742 Equifax: 1-800-685-1111 TransUnion: 1-800-916-8800.

    The FCRA allows consumers to get one free comprehensive disclosure of all the information in their credit file from each of the Repositories once every 12 months through a central source. Although comprehensive, the credit reports from each of the Repositories that are available through the Sites may not have the same information as a credit report obtained directly from the Repositories or through the central source.

    To request your free annual report under the FCRA, you must go to www.annualcreditreport.com or call 1-877-322-8228.

    Credit reports available through the Sites are not related to the free FCRA disclosure that you are, or may be, entitled to. The credit report you are requesting from through the Sites is not intended to constitute the disclosure of Experian, Equifax, or TransUnion information required by the FCRA or similar state laws. Consumers may have additional rights to receive free or reduced-cost credit reports based on applicable state law.

    You do not have to purchase credit repair services to correct inaccurate or outdated information in your credit report. You can do this yourself at no cost.

    You understand that it may be a violation of Federal and/or State law for you to obtain a credit report on any person other than yourself, and that under the FCRA, any person who knowingly and willfully obtains information on a consumer from a consumer reporting agency under false pretenses shall be fined under Title 18, United States Code, imprisoned for not more than two years, or both.

11. Disclaimers and No Guarantees

    The information provided through the Services is for general informational purposes only and does not constitute legal, financial, or other professional advice.

    We do not guarantee that your use of the Services will lead to improved credit scores or financial outcomes. We make no representations or warranties regarding the accuracy or completeness of the third-party information displayed in your dashboard.

    We may not be able to anticipate and foresee technical or other difficulties, which may result in failure to obtain personalized settings, data, or other service interruptions. We assume no responsibility for the accuracy, timeliness, deletion, failure or non-delivery to store any user data, communications or personalized setting or loss of user data.

12. Limitation of Liability

    To the fullest extent permitted by law, we disclaim all liability for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Website or Services, even if we have been advised of the possibility of such damages.

    You acknowledge and agree that you are responsible and bear all risks associated with the use of our Services, and that under no circumstances will we be liable in any way for any loss or damage of any kind incurred as a result of our Services.

    Users will not use the Services, if any applicable law in their State prohibits them from doing so and or have not previously been their right to use the Services because of suspension or termination.

    You agree to release us, our parents, partners, contractors and affiliates together with their respective employees, agents, officers, directors and shareholders, from any and all liability and obligations whatsoever in connection with, or arising from, your use of our Services.     Subject to your compliance with these Terms, Sure Credit grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services for your personal, non-commercial use only. This licence does not include any resale or commercial use of any Service or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of the Website or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools.

    No portion of the Services may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent. You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of Sure Credit without our express written consent. You may not use any meta tags or any other "hidden text" utilising Sure Credit's name or trademarks without our express written consent.

    Any unauthorised use terminates the permission or licence granted by SureCredit. You may not use any Sure Credit logo or other proprietary graphic or trademark as part of the link without express written permission.

    All trademarks not owned by SureCredit that appear on this site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Sure Credit. If you believe any content available on our site infringes your copyright or other intellectual property rights, please notify us immediately at [email protected] with detailed information regarding the alleged infringement.

17. Entire Agreement and Severability

    These Terms, and any Terms or Policies referenced herein, constitute the entire Agreement between You and Sure Credit, in relation to your use of the Services, Website and Products and supersedes any prior representations, inducements or agreements. You agree that these Terms are not intended to confer and do not confer any rights or remedies upon any third parties.

    If any parts of the Terms are held invalid or unenforceable, that portion shall be construed in a manner consistent with the applicable law to show, as closely as possible, the original intentions of the parties, and remaining portions shall remain in full tact.

    You may not assign these Terms or any of the rights granted under the same without the prior written consent of Sure Credit, and any attempted assignment without such consent shall be void. Subject to the foregoing restriction, these Terms will be fully binding upon, inure to the benefit of, and be enforceable by us and our respective successors and assigns. These terms may be assigned by us.

18. Non-waiver

    Failure by either party to exercise or enforce any right shall not be deemed to be a waiver of any such right nor operate so as to bar the exercise or enforcement thereof or of any other right on any later occasion.

19. Indemnification

    You agree to defend, indemnify and hold harmless us and its respective employees, contractors, officers, directors, shareholders, agents, representatives, vendors, and content providers from and against any and all liabilities, claims and expenses, including attorneys' fees, that arise from a breach of these Terms for which you are responsible or in connection with your transmission of any content to, on or through our Website.
